These terms govern the use of kievshipping.asia. The website is operated by Kiev Shipping Ltd (“Kiev Shipping”), a shipbroker working in ship chartering, maritime brokerage and commercial ship management since 2000, company IMO number 5628543.

By using the website you accept these terms. They cover the website only. Chartering business is governed by what is agreed between the parties in the recap and the charter party, not by this page.

What this website is

It is an information resource and a way to reach us. It describes the chartering services we provide, the cargoes and trades we work in, the voyages we have arranged, and it carries reference material on vessel types, stowage factors and charter-party forms. It also carries an enquiry form.

There is nothing else here. The website has no user accounts, no registration, no comments, no advertising and no payment functions. We do not publish user-submitted content.

What this website is not

Nothing on this website is an offer, a freight quotation, or a commitment to carry or to fix a vessel. Nothing on it creates a contract of carriage, a charter party or a booking.

Specifically:

• information about services, trades, vessel sizes and cargoes describes what we work with, not tonnage held available;
• we do not own vessels, and no vessel described on this website is offered as ours;
• voyages shown in the portfolio are completed business, presented as experience, not as capacity currently on offer;
• freight levels are never published here. A freight indication is given in correspondence, applies to a specific enquiry, and is not binding — the difference between an indication and a firm offer is explained in our published material and applies to everything we send.

Sending an enquiry

You may send a chartering enquiry through the form or by email. Doing so does not oblige you to anything, and it does not oblige us to quote, to find tonnage or to accept the business.

A fixture comes into existence only when main terms have been agreed, the subjects have been lifted and the recap has been circulated and accepted by the principals. Correspondence before that point — indications, proposals, vessel details, draft terms — is exchanged for the purpose of negotiation and is not a contract.

We rely on the cargo and vessel information you give us. Where it is incomplete or inaccurate, any indication based on it is unreliable, and we are not responsible for consequences flowing from information we were not given.

Reference material on this website

The website publishes technical reference material: indicative stowage factors, vessel size classes, cargo-handling notes, summaries of charter-party forms and Incoterms, and articles on chartering practice.

All of it is indicative and for general orientation. It does not replace the shipper’s declared cargo information, the applicable codes and regulations, laboratory certificates, class and flag requirements, a vessel’s own capacity and stability documents, or the advice of an appointed surveyor. Actual figures vary by grade, design, condition and shipment. Where a decision depends on a number, confirm it for the specific cargo and the specific ship.

Summaries of standard forms and trade terms are descriptions, not the documents themselves, and not legal advice.

Our role

Kiev Shipping acts as an independent shipbroker. Our work is commercial: finding suitable tonnage, obtaining and comparing offers, negotiating freight and terms, drawing the charter party from the recap, and following the voyage commercially.

We are not a carrier, a freight forwarder, an NVOCC or a technical manager. We do not provide container shipping, crewing, insurance, customs clearance, surveying, lifting or stevedoring services. Final vessel acceptance, stability and lifting calculations, securing arrangements and technical approvals remain with the vessel’s owners, the master and the appointed specialists.

Where we are engaged as broker, the scope of that engagement and the commission arrangements are set out in the recap of each fixture.

Accuracy and availability

We keep the website accurate and current as far as is reasonable, but we do not warrant that every figure, description or example is free of error or up to date at the moment you read it. Market information ages quickly.

The website may be unavailable at times, for maintenance or for reasons outside our control. We do not guarantee uninterrupted access.

Content and copyright

The texts, tables, diagrams, photographs and page design on this website belong to Kiev Shipping Ltd or are used with permission. Photographs of voyages are our own operational records.

You may read, print and quote from the website for your own business purposes, with attribution. You may not republish substantial parts of it, present our material as your own, or use our photographs, name, logo or voyage records in your own marketing without our written consent.

Where our material cites the IMSBC Code, the International Grain Code, standard charter-party forms or Incoterms, those documents remain the property of their respective publishers.

Links to other sites

The website links to the other sites in our own network and, in places, to third-party resources. We are not responsible for the content of sites we do not operate, and a link is not an endorsement.

Your use of the website

Use the website lawfully. Do not attempt to interfere with it, gain unauthorised access to it, scrape it at a rate that degrades service for others, or use the enquiry form to send unsolicited commercial messages, malware or unlawful material. We limit the rate of form submissions and may block access where the website is being misused.

Liability

To the extent permitted by law, Kiev Shipping is not liable for loss arising from reliance on general information published on this website, from the website being unavailable, or from decisions taken without confirming the specifics of a shipment with us or with the appropriate specialist.

Nothing in these terms limits liability that cannot lawfully be limited, and nothing in them affects rights and obligations under a concluded charter party or brokerage engagement, which are governed by those documents.

Changes

These terms may be revised. The version published on this page is the one that applies. Continued use of the website after a change means the revised terms apply to that use.

Governing law

These terms and the use of this website are governed by the law of Ukraine. Kiev Shipping Ltd is a Ukrainian company and conducts its business under Ukrainian law.

This does not extend to chartering business. The governing law and the forum for resolving a dispute under a fixture are those stated in the recap and the charter party for that fixture; charter parties commonly specify their own governing law and arbitration venue, and what was agreed there is what applies.
