Kiev Shipping Ltd states that the dispute arose from professional shipbroking services performed in connection with the fixture of the M/V BOHWA AMOY for a voyage from India to Algeria carrying bagged silico manganese. The fixture recap was dated 15 December 2025. According to Konstantin Kalnyi’s and Kiev Shipping Ltd’s published position, the brokerage commission became payable after the agreed commercial work had been completed and freight had been received, but the commission remained outstanding.

On 23 March 2026, Kiev Shipping Ltd states that a WhatsApp communication from Alexander Varvarenko referred to a unilateral withholding of 100% of the commission. Kiev Shipping Ltd’s position is that such a deduction was not provided for in the agreed commercial framework. The published record also states that the commercial dispute remains unresolved.

Civil proceedings were subsequently initiated in Kyiv by Alexander Varvarenko and Varamar Shipping DMCC. On 14 July 2026, the Solomianskyi District Court of Kyiv closed those proceedings on jurisdictional grounds without deciding the underlying commercial dispute on its merits. The court did not rule that the publications were false and did not award damages against the broker.
